This website, www.goldenspoonoliveoil.ca (the "Site"), is operated by GLOBCO FOODS INC., doing business as Golden Spoon ("Golden Spoon", "we", "us" or "our"), 1727B Saint Laurent Boulevard, Ottawa, Ontario K1G 3V4, Canada. By visiting the Site or purchasing something from us, you agree to these Terms of Service, together with our Privacy Policy, Shipping Policy and Refund Policy. Please read them carefully. If you do not agree, please do not use the Site.

Our store is hosted on Shopify Inc., which provides the online e-commerce platform that allows us to sell our products to you.

1. Who may use the Site

By using the Site you confirm that you are at least the age of majority in your province or territory of residence, or that you have the consent of a parent or guardian. You may not use our products for any illegal or unauthorized purpose.

2. Products, prices and availability

All prices are in Canadian dollars (CAD) unless otherwise stated. Prices, products and promotions may change at any time without notice. We make every effort to display our products accurately, but colours, labels and packaging may vary slightly from the images shown. Product weights and volumes are nominal.

We reserve the right to limit quantities, to discontinue any product, and to refuse or cancel any order, including orders that appear to be placed by dealers or resellers, or where a pricing or typographical error has occurred. If we cancel an order after you have paid, we will refund you in full.

3. Orders and payment

When you place an order, you are making an offer to buy. We accept your offer when we ship the product; an order confirmation email is an acknowledgement, not an acceptance. You agree to provide complete and accurate purchase and account information, including a current email address and phone number so we can contact you about your order. Payment is processed at the time of order through Shopify's secure checkout.

4. Shipping, risk and taxes

Shipping terms, rates and estimated delivery times are set out in our Shipping Policy. Risk of loss passes to you when the carrier delivers the order to the address you provided. Applicable sales taxes are calculated at checkout. For international orders, you are responsible for any duties, taxes or customs fees charged by the destination country.

6. Product information and health claims

Golden Spoon extra virgin olive oil is a food product. Information on this Site about olive oil, polyphenols, nutrition or health, including on our blog, is provided for general interest only. It is not medical advice and is not intended to diagnose, treat, cure or prevent any disease. Consult a qualified health professional before making dietary changes. Lab results and certificates published on the Site relate to the samples and lots indicated in the documents.

7. Accuracy of information on the Site

We try to keep the Site accurate and up to date, but we are not responsible if information is inaccurate, incomplete or out of date. Any reliance on the material on this Site is at your own risk. We may update the Site at any time but are under no obligation to do so.

8. Intellectual property

The Golden Spoon name, logo, label designs, photographs, text and other content on the Site are owned by or licensed to GLOBCO FOODS INC. and are protected by Canadian and international copyright and trademark law. You may not copy, reproduce or use them without our written permission, other than to view and print pages for your own personal, non-commercial use.

9. Prohibited uses

You may not use the Site or its content: for any unlawful purpose; to infringe our or anyone else's intellectual property rights; to submit false or misleading information; to upload or transmit viruses or malicious code; to collect or track the personal information of others; to scrape, spam, phish or crawl the Site other than through public search engines; or to interfere with the security or operation of the Site. We may terminate your use of the Site for violating any of these rules.

10. User content and reviews

If you send us comments, reviews, suggestions or other material, you agree that we may use, edit, copy and publish it in any medium without restriction or compensation, and that it does not violate the rights of any third party. We may, but are not obliged to, monitor, edit or remove content we consider unlawful, offensive or otherwise objectionable.

11. Third-party links and tools

The Site may contain links to third-party websites and use third-party tools (for example, payment processing or shipping tracking). We are not responsible for the content, accuracy or practices of third parties, and your use of them is at your own risk and subject to their terms.

12. Disclaimer of warranties; limitation of liability

Except as required by applicable consumer protection law, the Site and our products are provided "as is" and "as available" without warranties of any kind, express or implied. To the fullest extent permitted by law, GLOBCO FOODS INC., its directors, officers, employees and suppliers will not be liable for any indirect, incidental, special or consequential damages arising from your use of the Site or any product purchased through it, and our total liability for any claim will not exceed the amount you paid for the product concerned. Nothing in these terms limits any rights you have under the Consumer Protection Act, 2002 (Ontario) or other applicable consumer laws that cannot be excluded.

13. Indemnification

You agree to indemnify and hold harmless GLOBCO FOODS INC. and its affiliates, officers, employees and suppliers from any claim or demand, including reasonable legal fees, arising out of your breach of these Terms of Service or your violation of any law or the rights of a third party.

14. Governing law

These Terms of Service and any separate agreements under which we provide products to you are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any dispute will be brought in the courts of Ontario, without prejudice to any mandatory consumer protection rules of your place of residence.

15. Changes to these terms

We may update these Terms of Service at any time by posting the revised version on this page and updating the "Last updated" date. Your continued use of the Site after changes are posted means you accept the revised terms. Any provision found to be unenforceable will be severed without affecting the rest of the terms.
